1. Acceptance of Terms

By accessing or using the AZURE website (azureexperiences.com) or by submitting an inquiry or charter booking, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Services

AZURE acts as a concierge and broker connecting clients with independent vessel operators and service providers in Los Cabos, Mexico. We do not own the vessels in our fleet. All charters are operated by independent, licensed third-party captains and crews.

3. Bookings & Reservations

All charter inquiries submitted through our website are non-binding until confirmed in writing by AZURE and the client. A booking is considered confirmed only upon:

• Receipt of a signed charter agreement or confirmation email from AZURE.
• Payment of the required deposit as specified in the charter agreement.

Pricing displayed on the website is indicative and subject to change based on availability, season, and specific charter requirements.

4. Payments & Deposits

Payment terms, deposit amounts, and accepted payment methods will be specified in the charter agreement provided upon confirmation. All prices are quoted in USD unless otherwise stated. Crew gratuity is not included in quoted prices; 15–20% is customary.

5. Cancellations & Refunds

Refund eligibility is determined by the time remaining before your scheduled charter date:

• More than 48 hours before charter: Full refund of deposit.
• 48 to 24 hours before charter: 50% refund of deposit.
• Less than 24 hours before charter: Non-refundable.
• Cancellations due to severe weather or unsafe sea conditions at the captain's discretion will be rescheduled or fully refunded.

All refund requests must be submitted in writing. Processing may take 5–10 business days.

6. Guest Conduct & Safety

All guests must comply with the instructions of the captain and crew at all times. The captain has the authority to terminate a charter if any guest behaves in a manner that endangers the safety of other guests, the crew, or the vessel. In such cases, no refund will be issued. AZURE and its operators reserve the right to refuse service to any individual.

7. Limitation of Liability

AZURE acts as an intermediary and is not liable for the acts, omissions, or negligence of any vessel operator, captain, crew member, or third-party service provider. Our total liability to you for any claim shall not exceed the amount paid by you to AZURE for the specific charter in question.

8. Intellectual Property

All content on this website — including text, images, logos, and design — is the property of AZURE or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without prior written permission.

9. Governing Law

These Terms of Service are governed by the laws of the United Mexican States and the State of Baja California Sur. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Los Cabos, BCS, Mexico.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on this page with a revised date. Continued use of the website after changes constitutes acceptance of the updated terms.
